CONTRACT FOR CELLO LESSONS

The Cello Corner

 

TERMS AND CONDITIONS:

This contract governs the relationship between the parent (or guardian) of a Suzuki cello student and the teacher.

 

    1.Musician’s Union

  • The Cello Corner is protected by the Musician's Union with regards to legal issues, the costs of taking legal action in connection with this contract and indemnity insurance.
  1. Regular Attendance, Terms and Minimum Number of Lessons
  • Regular attendance of all lessons is expected, subject only to illness.  Please see paragraph 9, ‘Cancellation Policy’, below for further details as to when and how lessons can be cancelled.
  • Each student is expected to attend a minimum number of lessons per term.  Term dates vary, and they are published on the Cello Corner website, www.cellocorner.co.uk.
  • In each term, the student must attend both weekly individual lessons as well as weekly group lessons.
  1. Practising and Role of the Parent
  • Careful, regular practice as advised by the teacher is a prerequisite for success with a musical instrument. It is important to note that whilst the teacher aims to ensure that the student makes acceptable progress, this can only be achieved if the student accepts the teacher’s advice and puts it into practice.
  • Parents or guardians of students have to attend their child's cello lesson and bring a notebook/camera along in order to take notes.  Once the cello lesson is finished, the parent has to take on the role of the "home teacher".
  1. Ensemble & Chamber Music
  • Children studying at The Cello Corner need to attend cello ensemble classes once a week in addition to their weekly one-to-one cello lesson.  
  •  If a student is unable to attend a group lesson, the teacher must be notified in advance.
  1. Duration of Lessons and Punctuality
  • The duration of lessons will be fixed by the teacher in each case, depending on the concentration span of the student.  By way of example, individual lessons will last between 30 and 60 minutes, and ensemble classes will last between 45 and 75 minutes, depending on the age and the level of the students. 
  • The student must please be punctual for all lessons, and in particular ensemble classes. To ensure that lessons are not delayed, the student must arrive 10-15 minutes before the scheduled start time for any class, to allow for the time required to set up and tune properly. 
  • Any late arrival means that lessons may have to be cut short.  The teacher is not required to make up time and extend lessons that have been delayed.
  • Late arrivals to ensemble classes may need to wait outside the teaching room until a suitable break in the lesson before they can be admitted to participate.
 

 

  1. Payment for Lessons
  • The student’s parent or guardian is required to pay for lessons in advance, for each term, as follows:
    • Payment may be made per term.  The fee per term varies, depending on how many weeks each term has, and the individual programme of lessons for the student.  The fee for each student will be set out in a fee schedule, to be provided by the teacher and agreed by the parent.  All fees are subject to review on an annual basis.
    • Payment for any term includes the minimum number of individual and ensemble classes.
    • Payment for the student’s first term of lessons must be made within 14 calendar days from the date of signing this contract.
    • Thereafter, payment for each term must be made within 14 calendar days of the first day of the relevant term.
    • Alternatively, payment can be made for a full year (so for three successive terms,).  Such annual payment includes the minimum number of individual and ensemble classes for the relevant one-year period.  The annual fee will be determined in the same way as the fee per term, through a fee schedule provided by the teacher and agreed by the parent.
    • Annual payment must be made within 14 calendar days of the first day of the first term of the relevant one-year period.
    • Payments are due in full, regardless of whether the student is subsequently unable to attend any lesson during the relevant period.  There is no obligation to provide any refund in the event of non-attendance.  
    • Payments may be made either by electronic bank transfer or standing order.  In case of payment by standing order, this must be put in place for at least 12 months.
    • All fees are subject to review on an annual basis.
    • If a student wishes to take additional individual or ensemble lessons, beyond the minimum number included in the payment for the relevant term, such additional lessons will be charged at the agreed rate, depending on the length of the lesson.
    • Payment for any additional lessons can be made on the day.
 

 

  1. Cancellation Policy for Lessons
  • If the student is unable to attend a lesson due to illness or for any reason, then the teacher should be informed at least 24 hours in advance, unless that is impossible due to circumstances beyond the student/parent’s control, in which case the teacher should be given as much notice as possible. 
  • If any lesson is cancelled by the student, the teacher will seek to reschedule the lesson during the same week.  If that proves impossible, the teacher will be under no obligation to re-schedule the lesson.  The student will be liable for the full cost of any lesson that has been cancelled.  Any lesson that has been cancelled by the student cannot be carried forward into the next term.
  • The teacher will make every effort to provide all lessons as scheduled.  In the event that the teacher is not available for a lesson due to illness, unavoidable conflicts with other engagements or circumstances beyond the teacher’s control, then the teacher will give as much notice of cancellation as is possible in the circumstances.   
  • If a lesson is cancelled due to the teacher being unavailable, the teacher will propose an alternative date during the same term or provide a substitute teacher.
  1. Duration and Termination of this Contract
  • This contract for cello lessons is for one term and thereafter renews automatically for additional terms unless the parent (or guardian) gives notice of termination in writing.
  • Notice of termination must be given no later than 14 days from the start of the term that is intended to be the final term of this Contract. 
  • Notice of termination can be given either by letter to the Cello Corner, 179 Offord Road, London N1 1LR or by email to studying@thecellocorner.co.uk.  
  • If the parent does not give notice of termination as set out above, then the contract automatically renews and continues for the next term.  In that event, the parent (or guardian) becomes liable to pay the fee for the next term in full, pursuant to Clause 8 above.
  • If upon termination of this contract, the parent (or guardian) has already paid fees for subsequent terms (for which no lessons will be provided following termination of the contract), then the teacher will refund all payments already made that relate to such future (cancelled) terms.
  1. Equipment for the Student and Instrument Insurance
  • The student (or parent/guardian) agrees to pay for any music/ strings/repairs etc. required by the student and provided by the teacher.
  • The parent/student has to provide his or her own cello.  This can be rented or purchased from a source recommended by the Cello Corner.
  • The student (or parent/guardian) is responsible for the insurance of the student's instrument.
  • Every child needs his own cello chair (http://www.safrut.co.il/English--Mini-Max.htm) and spike holder. The parent needs to bring this chair to any group lesson, concert or workshop.
  1. Limitation of Liability
  • The teacher shall be under no liability to the student, parent (or guardian) for anything arising out of or in connection with this contract, including but not limited to any lessons, public performances or private practice.  Any such liability on the part of the teacher is hereby excluded to the maximum extent permitted by law, including as regards negligent acts or omissions on the part of the teacher.
  • The student (or parent/guardian) will be responsible for any loss or damage sustained to any instrument/accessory or music loaned by the teacher to the student. Such items will be returned to the teacher on request.
  • For any damage caused by the student/child to the studio, the parent/guardian will be held responsible. Although the studio is insured, damages up to £500 are expected to be paid by the parent/guardian due to the excess rate of the insurance.
  1. Concerts (Including Concert Fee)
  • Concerts: Participation in regular 'The Cello Corner' concerts is expected and involves a fee at the beginning of the term. If a student can't make the concert date the fee is still payable.
  • Every concert has a final rehearsal, attendance at which is obligatory.  Students who do not attend this rehearsal, even if due to illness, will not be allowed to perform at the concert.
  1. Other Public Performances
  • The student will not enter any concert/ examination/ festival/competition or otherwise perform in public without consulting the cello teacher. Cello teachers will not enter the student for an examination/festival etc. without the approval of the student (or parent, guardian). Any entry fee for such examinations and festivals will be paid by the student (or parent, guardian).
  • The student may not perform publicly unless the teacher has been notified.
  1. Parent to Supply Information about Medical Conditions and Wellbeing of the Student
  • In the interest of the student's well-being whilst in the teacher's care, the teacher must be informed of any medical or other condition affecting the student.
  1. Law and Jurisdiction
  • This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
  • Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
